]]> An overview of the upcoming changes to the Sponsorship Visa 482 in Australia for 2024, as part of the 10-year Migration Strategy.

A 10-year Migration Strategy for Australia was announced by the Australian government in December 2023, and one of the significant changes to expect in 2024 is related to the Sponsorship Visa 482.

According to the Australian Government, the new Migration Strategy aims to refocus Australia’s skilled migration system on developing an innovative and efficient workforce for the country’s future.

“We need a system that encourages, rather than prevents, workers in emerging occupations to join the Australian labour force” – Technology Council of Australia.

Here is a summary of what to expect for the sponsorship visa in 2024:

Sponsorship Visa 482 – Upcoming Changes for 2024

A new three-tiered system of visa pathways is set to replace the current TSS 482 Sponsorship Visa in 2024. Here’s what you need to know about it and the basic eligibility criteria for each pathway:

1 – Specialist Skills Pathway

  • Available to highly skilled specialist professionals who meet the general eligibility criteria (for example, be nominated by an approved employer, meet the health and character requirements) and who are:
    • in any occupation except trades workers, machinery operators and drivers, and labourers
    • earning or being offered at least $135,000 (the Specialist Skills Threshold) and no less than Australian workers in the same occupation.

2 – Core Skills Pathway

  • The Core Skills Pathway would be available to applicants who meet the general eligibility criteria (pretty much what the 482 visa is now) and:
    • whose occupation is on a new Core Skills Occupation List (which includes occupations such as trades workers, machinery operators and drivers, for example
    • earning a salary at or above the TSMIT $70-135,000

3 – Essential Skills Pathway

  • Focus on a more regulated pathway for lower-paid workers with essential skills, vital to supporting the living standards of Australians and where persistent shortages exist.
    • For those earning under $70,000
    • The Government will further evaluate how to develop and implement this visa pathway

When will these changes come into effect? 

According to the Action Plan published by the government, the changes to the Sponsorship Visa 482 will come into effect in “ late 2024”. Until then nothing changes!

IMPORTANT: If you are applying for a 482 visa before the end of 2024, all current requirements and legislation remain. As no one really knows what the new 3 pathways will require of applicants, we recommend that you lodge your 482 TSS visa as soon as possible to avoid changes that will impact you negatively.

If you already hold a 482 TSS visa none of the announcements will affect your current visa, even when they are implemented.

Will all three new pathways lead to PR via 186?

We believe it is likely to be the case: the current government has recently announced an expansion of the eligibility for the Employer Nomination Scheme – Subclass 186 visa, via Temporary Skill Shortage visa (TSS Sponsorship Visa) – Subclass 482, so it wouldn’t make sense to change that again anytime soon.

Requirements

The highest priority for an invitation to apply for nomination is given to eligible registrations of interest (ROIs) that demonstrate at least three months of directly related skilled employment in one of these areas and undergo a skills assessment.

ROIs that have already been submitted and include employment directly related to a skills assessment for an occupation added to the list will be ‘re-scored’ and invited to apply for nomination.

New ROIs that include employment directly related to a skills assessment for an occupation removed from the list will not be automatically invited to apply but will still be a high priority for nomination.

2 – Tasmanian Onshore Skilled Occupation List (TOSOL) Updates

The Tasmanian Onshore Skilled Occupation List (TOSOL) has been updated to align with the new critical roles list, now including ANZSCO Group 2324 – Graphic and Web Designers and Illustrators.

Requirements:

  • Subclass 190 visa nomination: Requires at least six months of employment in a directly related position in one of the occupations listed. (All occupations are eligible for subclass 190 nomination after 15 months of employment in Tasmania.)
  • Subclass 491 visa nomination: Requires at least three months of employment in a directly related occupation in one of the occupations listed on the TOSOL.

3 – Green Pass Holders

Another update in the Tasmanian Skilled Migration Nomination Program has been announced, specifically regarding the priority given to Gold or Green pass holders. These individuals will receive prioritized nomination invitations due to the limited number of nomination allocations received this year.

All subclass 190 nomination places were initially expected to be filled by early May 2024 within an 8-week timeframe. However, due to the high levels of interest in subclass 190 nomination, this timeframe has been extended.

As for subclass 491, individuals with ROIs (Registrations of Interest) and a green pass are currently being invited within two to three weeks.”

4 – Skilled vs Lower-Skilled Roles

To qualify for gold or green attributes linked to employment, the position must align with ANZSCO Skill Level 1, 2, or 3.

Skilled employment will be acknowledged if there is a minimum of a 70% correspondence between your role and the occupation description categorized under ANZSCO as Skill Level 1, 2, or 3.

In the case of the Tasmanian Skilled Graduate and Tasmanian Established Resident pathways, there is greater flexibility – the correspondence should be at least 40%

Roles primarily involving administrative support will not be considered as skilled positions.

5 – Processing Times and Nomination Quota

Skilled Nominated (subclass 190) visa:

  • Nominations – 358 of 600 places used
  • Nomination applications lodged but not decided – 31
  • Invitations to apply for nomination issued but not yet accepted – 18
  • Registrations of interest on hand – 487

Skilled Work Regional (subclass 491) visa:

  • Nominations – 251 of 600 places used
  • Nomination applications lodged but not decided – 23
  • Invitations to apply for nomination issued but not yet accepted – 14
  • Registrations of interest on hand – 389

MIA Notice 31 – 11 December 2023: Migration Strategy – First news

The new strategy was designed to make our skilled migration system more focused on skills required to build productivity and use permanent migration to build and innovative and effective workforce for Australia’s future.

The strategy is based on 8 key actions:

1. Targeting temporary skilled migration to address skills needs and promote worker mobility

2. Reshaping permanent skilled migration to drive long-term prosperity

3. Strengthening the integrity and quality of international education

4. Tackling worker exploitation and the misuse of the visa system

5. Planning migration to get the right skills in the right places

6. Tailoring regional visas and the Working Holiday Maker program to support regional Australia and its workers

7. Deepening our people-to-people ties in the Indo-Pacific

8. Simplifying the migration system to improve the experience for migrants and employers

Skilled temporary visas

A new three tiered system of visa pathways to replace the TSS SC 482. The ‘essential skills’ visa for those earning under $70,000, the ‘core skills’ visa for the $70-135,000 cohort and the ‘specialist skills’ visa for those earning over $135,000 per year.

  • The specialist skills visa pathway will not have an occupational list and a processing turnaround of 7 days. Trades occupations, machinery operators, drivers and labourers will be excluded from this visa class. There will be 3,000 places allocated per year.
  • The core skills visas pathway are expected to provide the majority of visa for the program.
  • Trades workers will be required to apply under this visa based on a revised ‘skills in demand list’ developed by Jobs and Skills Australia.
  • The details of the essential skills visa pathway are yet to be finally determined. This visa will involve union oversight, be capped and be restricted to specific sectors. To date the aged care and disability sectors have been mentioned.
  • The visas will be granted for up to 4 years and visa holders will be able to change employers more easily and provide clear pathways to permanent residency. The ‘TSMIT’ will be indexed annually and a public register of employer sponsors to allow more ease with moving between employers.

Skilling Australians Fund

Consideration will be given to collecting the SAF in smaller increments over time in recognition of the greater freedom of visa holders to change employers. A monthly or quarterly payment model will be explored.

Labour Market Testing

LMT is to be streamlined, although the only announcement so far is that the requirement to advertise on the Workforce Australia site will be abolished. The validity of advertising period will increase from 4 to 6 months.

LMT will be gradually phased out as Jobs and Skills Australia data on skills shortages improves and a Core Skilled Occupation List created as an alternative to LMT.

Points tests

The points test will be reviewed. Further consultation will occur on a new points test, with the development of a new analysis-based points test to identify more effectively the independent migrants who will make the greatest contribution to the country. This pathway will have a faster pathway to permanent residence for graduates working in skilled jobs.

Temporary Graduate Visas

  • reducing the length of stay for international graduates
  • preventing holders of the new graduate visas from moving back onto student visas
  • preventing the stay of International graduates without skills in demand from remaining in Australia.
  • reducing the age eligibility from 50 to 35 years of age
  • increased English language levels for temporary graduate visas

Student visas

There will be significant changes to the student visa program, although the number of places will not be capped. Instead other migration levers will be used to control numbers, including;

  • higher English language levels for student visa applicants
  • reducing the types of courses eligible for student visas with the focus on retaining tertiary university courses
  • preventing course swapping
  • increased funding for visa integrity and to identify the ‘genuine student test’.

Working Holiday Makers

No changes at this stage to the WHM program although the length of stay and the 88 day rules are under consideration.

Global Talent and Business Skills

The Global Talent program will be more sharply focused on a relatively small number of migrants who can make outsized contributions to Australia. There will be consideration of a new ‘talent and innovation’ visa.

The Business Innovation and Investment Program has seen over 80% of company directors invest in small retail or hospitality businesses, rather than in sectors that will drive Australia’s future innovation and productivity. The Significant Investor Visa program looks set to continue with some further adjustment.

Registered Migration Agents

The Government will consult on the feasibility of limiting the involvement of unregistered overseas providers in the migration system, and severely curtail and monitor the provision of unqualified advice from influencing the visa lodgement process.

Strengthening the regulation of registered migration agents (not detailed in the strategy) and combat providers of unscrupulous immigration assistance, including increasing financial penalties.

]]> The NSW Occupation Lists indicate the professions needed to address skill shortages in the state, allowing individuals to apply for a visa through the Skilled Migration Program.

The requirements for Regional Visas in all States and Territories are updated annually, and NSW has released and opened its 2023/24 Nomination Program for applications for both visa Subclasses 190 and 491.

New South Wales is shifting from publishing Occupation Lists to a new sector-focused approach, focusing on priority sectors that need skilled talent. They are:

  • Health 
  • Education 
  • Information and Communication Technology (ICT) 
  • Infrastructure  
  • Agriculture 

However, according to the State’s Government, high-ranking EOIs submitted in non-priority sectors may also be considered.

New South Wales’s 2023-24 Skilled Visa Nomination Program

Status: Open to eligible applicants living in NSW and overseas.

NSW Process

To be selected by New South Wales and invited by SkillSelect, you must first submit an Expression of Interest (EOI) with SkillSelect. 

Basic Requirements

To be considered for NSW nomination, you must meet all visa requirements outlined by Home Affairs:

  • score at least 65 on the points test – unless NSW requires a higher score;
  • have an occupation in one of the NSW Skilled Occupation lists;
  • have a positive skills assessment in your nominated occupation;
  • be under 45 years of age;
  • meet the minimum English language requirement for your occupation;

Updates on the NSW 2023—24 Skilled Migration program

NSW 190 Visa

Requirements

  • Must nominate an occupation in the instrument for the visa. Target Sectors will be prioritised and most likely only those who can nominate an occupation there will be selected to apply for State Nomination. Occupations in other sectors may be selected;
  • Candidates must be currently living in NSW or living offshore for at least 6 continuous months;
  • Each occupation has a minimum score on the Points Test required

NSW 491 Visa

Requirements:

  • Candidates must be currently living in NSW or living offshore for at least 3 continuous months;
  • There are two pathways to NSW nomination for this visa:

Pathway 1 – Apply directly to a Regional Development Australia (RDA) office.

Requirements:

  • You must be currently living and working in a designated regional area of NSW, and;
  • Have continuously done so for the past 12 months.  

Your qualifying skilled employment in the twelve months immediately before applying must be:  

  • With a single regional NSW-based employer; and
  • In your nominated (or closely related) occupation; and 
  • Deemed skilled by NSW; and 
  • Paid a minimum of the TSMIT salary level of $70,000

Pathway 2 – Invitation by Investment NSW 

  •  Candidates selected by Investment NSW based on the need for their skills in NSW.

*NSW nomination for this visa under ‘Pathway 2’ is exceptionally competitive. Consequently, we strongly recommend you have a Plan B. This is crucial for the success of your migration journey.

The Australian Government recently announced a plan to enhance the protection of infrastructure against cyber threats, as reports of cybercrime have risen by 23% compared to the previous year. 

The 2023-2030 Australian Cyber Security Strategy aims to strengthen Australia’s cybersecurity. The government has already allocated an additional $586 million to this strategy, supplementing the existing $2.3 billion cybersecurity budget.

All of this has significant implications for Australian immigration, particularly in the realm of skilled migration.

How can Australia’s cybersecurity create opportunities for immigration?

Among other strategies, the plan includes attracting migrants with cyber expertise to strengthen Australia’s cybersecurity workforce. This approach acknowledges the global nature of cyber threats and the necessity of a diverse, highly skilled workforce to combat these challenges. 

For Australia, this could mean an increased demand for specific visa categories tailored to skilled professionals in the cybersecurity sector. This initiative aligns with Australia’s broader objectives to fortify its digital infrastructure and develop a robust, resilient cyber defence system.

]]> The Western Australia Occupation Lists indicate the professions needed to address skill shortages in the state, enabling individuals to apply for a visa through the Skilled Migration Program.

The requirements for Regional Visas in all States and Territories are updated annually, and WA has already released and opened its 2023/24 Nomination Program for applications for both visa Subclasses 190 and 491.

All individuals interested in applying for a Skilled Visa within Western Australia must meet the following criteria: have an occupation on the relevant occupation lists, satisfy the specific state requirements, and meet the basic requirements defined by the Department of Home Affairs.

Western Australia’s 2023-24 Skilled Visa Nomination Program

Status: Open to applicants living in WA and overseas from 8 August 2023.

Updates on the 2023—24 program

The requirements are now more flexible compared to last year.

  • There is no application fee.
  • Interstate and overseas applicants will now receive equal invitation rankings.
  • Employment requirements for candidates invited through a WA building and construction industry sector occupation will be reduced.

Candidates with occupations deemed critical within a WA industry sector will receive priority.

Basic Requirements

To apply for a permanent Skilled Nominated 190 visa or a temporary Regional 491 visa with Western Australia’s nomination, you must be pre-selected by the state and receive an invitation to apply for State Nomination. This system operates on an ‘invitation only’ basis. If WA agrees to nominate you, SkillSelect will invite you to apply for the visa.

To be selected by Western Australia and invited by SkillSelect, you must first submit an Expression of Interest (EOI) with SkillSelect. You will only receive invitations from WA and the Department of Home Affairs if you meet the following requirements:

  • score at least 65 on the points test – unless WA requires a higher score;
  • have an occupation on the relevant WA Occupation List;
  • have a positive skills assessment in your nominated occupation;
  • be under 45 years of age;
  • meet the minimum English language requirement for your occupation;

Before we focus on the Western Australia Occupation Lists, let’s discuss the streams available in WA and its requirements:

There are 3 streams available:

General stream WASMOL schedule 1 and 2

  • currently residing in Western Australia
  • currently residing offshore or in another Australian state or territory
  • occupations in priority WA Industry sectors:
    • building and construction;
    • healthcare and social assistance;
    • hospitality and tourism; and
    • education and training.
  • occupations in all other WA industry sectors (Listed on the WA Skilled Migration Occupation List (WASMOL) Schedule 1 or 2) 
  • If applying under Schedule 1: at least one year of Australian OR overseas work experience in the nominated (or closely related) occupation over the last 10 years; or
  • If applying for the 190 visa: have a full-time employment contract in WA for a minimum of six months in the nominated (or closely related) occupation.

*The work experience requirement is not applicable to anyone invited through the General stream WASMOL schedule 2.

Graduate stream

  • Have occupation on the Graduate occupation list;
  • Must also have completed a Certificate III or higher level qualification in WA;
  • Had 2 years of face-to-face full-time study in WA from an accredited WA training provider

*Study from different WA qualifications can be used to make up the two-year study requirement component.

*Study gained through an English language program can be used to meet the 2-year study requirement, as long as you have also completed at least one of the qualifications listed above.

With the Department of Home Affairs’ latest announcement, the journey to permanent residency (PR) for holders of the Temporary Skill Shortage (subclass 482) Sponsorship visa is about to become more accessible.

What Employers Need to Know about the Sponsorship Visa Changes

The forthcoming changes mark a pivotal development for Australian businesses that rely on skilled international talent. 

Broadening the Talent Pool

Come 25 November 2023, the scope for nominating skilled workers for PR expands beyond current limitations. Employers will have the ability to nominate workers from all TSS visa streams. 

In practice this means that there are no more occupation restrictions or occupation lists: if your workforce holds 482 TSS visas, you will have the option to nominate them. At the moment this is restricted to certain occupations in high demand (those on the Medium and Long Term Skills Shortage List (MLTSSL)).

The Department of Home Affairs believes this will help employers “to attract and retain the skilled workers Australia needs”. What Skilled Workers Need to Know about the Sponsorship Visa changes

For individuals currently on a 482 TSS visa or contemplating one, these reforms create a pathway to making Australia a permanent home.

Permanent Residence for all 482 visa holders

Regardless of your occupation, if you apply for a 482 TSS visa or if you already have one, you will have the possibility to apply for the permanent Subclass 186 Employer Nomination Visa via the Temporary Residence Transition Stream, regardless of your occupation.

If your occupation is on the ANZSCO Code there will be a pathway, but you must meet all other eligibility criteria for the 186 visa and that includes your employer agreeing to nominate you.

A Permanent Visa faster

You will also be eligible for the 186 visa faster: as of today you need to work in the same position while holding a 482 visa for 3 out of the last 4 years. From  25 November 2023 this will change to 2 out of the last 3 years. Even if you already had a pathway to a permanent 186 visa, your occupation being on the MLTSSL, you will benefit from these changes as you will qualify faster.

What is not changing

  • These changes are applicable to the Temporary Residence Transition Stream only (TRT). If you want to apply for a 186 visa via the Direct Entry Stream, you still will have to nominate an occupation on the MLTSSL.
  • If you hold another type of work visa such as a Graduate Visa 485, a Regional Employer Sponsored Visa 494, a Training Visa 407, or others, you can’t apply for a 186 visa via the TRT. This has never been possible and will continue not to be possible.
  • The maximum age for a primary applicant of the 186 visa is still 45 years, with very few exceptions. This has not changed.

These changes are a true transformation of the Skilled Migration program, for both employers and skilled workers in Australia. For employers, the opportunity to harness global talent is being significantly enhanced. For skilled workers, the dream of becoming permanent residents is closer to reality.

]]> The Northern Territory Occupation Lists indicate the professions needed to fill skill shortages in the region and those eligible to apply for a Visa through their Skilled Migration Program.

The Northern Territory has opened its Nomination Program for 2023/24, accepting applications for Subclass 491 only. They revealed not being able to accept new applications for Subclass 190 this program year due to limited nomination allocations from the Australian Government. 

This article will explain the subclass 491 nomination process in detail and provide complete Skilled Occupation Lists for your reference.

Northern Territory’s 2023-24 Skilled Visa Nomination Program

Status: Open for subclass 491 only from 23 October 2023 for onshore and offshore applicants.

Process:

  • You must commit to living and working in the NT in your skilled occupation or a closely related skilled occupation for at least three years from visa grant

In addition to the above, applicants must also meet the Northern Territory Government requirements.

Northern Territory’s Skilled Nomination Requirements 

NT Graduates

  • NT Graduates who currently hold a Temporary Graduate subclass 485 visa valid till at least 1 July 2024, or are eligible for such visa will not be eligible for nomination in this program year;
  • Those who do not have access to a subclass 485 visa will be considered for a subclass 491 nomination subject to meeting the following criteria:
    • successfully completed one or more qualifications after studying in the NT, at an NT-based institution for two years in a single tertiary course or a set of nested tertiary courses, and
    • demonstrated genuine and sustained efforts to obtain employment from an NT employer in your nominated occupation or a closely related skilled occupation.

Onshore applicants

  • Demonstrate that you have been residing in the NT for at least 12 consecutive months;
  • Demonstrate that none of your migrating dependants are residing in another part of Australia;
  • Demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate that the employment is available for at least a further 12 months.
    • If your work experience was not in a nominated or related occupation, NT will only consider if the job is in a critical sector (health, aged and disabled care, education and childcare, hospitality);
  • if you or any of your migrating dependants are currently on a student visa and have not completed studies in an NT institution, you will not be eligible for NT nomination;

Offshore applicants

  • Have post-qualification work experience of at least one year in your nominated occupation in the last 10 years;
  • Demonstrate a genuine commitment to live and work in the NT on a long-term basis;
  • Have evidence of financial capacity to settle in the NT;
  • The Priority Occupation Stream for offshore applications will be limited to 54 occupations listed on the new NT Offshore Migration Occupation List.

Offshore applicants must also meet criteria against one of the 3 streams below:

1 – Priority occupation stream

  • have a full migration skills assessment in an occupation listed on the Northern Territory Offshore Migration Occupations List (NTOMOL);
  • meet any additional work experience required for the occupation as specified on the NTOMOL.

2 – NT Family Stream

  • Have a family member (parent, child, siblings, uncle, aunt, nephew, niece, first cousin or grandparent) in the NT who:
    • is an Australian citizen, an Australian permanent resident, an eligible New Zealand citizen, OR
    • hold one of the following visas: 491, 494, 489, bridging visa for the 887, 191, OR
    • is usually resident in the Northern Territory, and has been living in the NT for at least 12 months;
    • have evidence of sustained efforts to seek employment in the NT;

3 – NT Job Offer Stream

Offshore applicants under this stream must have a job offer in their nominated occupation for a job that is based in the NT with an NT business/organisation that has been actively operating in the NT for at least 12 months

482 Visa Application Process Step-by-step

Stage 1: Employer Sponsorship

Before looking into the 482 visa application, the primary step is for the employer to obtain a Standard Business Sponsorship (SBS) approval.

This requires the employer to demonstrate that they are legally operating in Australia and possess the capacity to uphold the responsibilities of a sponsor, with a focus on their ability to pay for the proposed employee’s salary.

In a lot of cases, this step requires the employer to test the labour market and show evidence that they couldn’t find an Australian to fill the position, as well as make a monetary contribution to a Skilling Australians fund.

Stage 3: Visa Application:

Upon successful nomination, the visa application stage commences.

The applicant must submit a visa application under one of the subclass 482 visa streams:

  • Short-term stream,
  • Medium-term stream, or
  • Labour Agreement stream

The visa applicant has to meet minimum levels of English language proficiency and skills, with at least 2 years of full-time work experience.
